After 9/11, security became the top priority for the United States. It became the catalyst for many laws, including the REAL ID Act. Basically, the act put forth a set of requirements that were to act as “minimum security standards” for issuing and licenses and producing licenses. It also banned Federal agencies (like the FAA) from accepting driver’s licenses from states that hadn’t complied to these minimum security standards as a form of ID for certain purposes. One of those purposes is boarding a commercial aircraft.
Simply put, if your state hasn’t conformed to the REAL ID minimum security standards by January 22, 2018 and you try to offer your driver’s license as a form of ID, you won’t be allowed to get on your flight.
As it stands, there are several forms of extensions that were in place for various states. However, as of January 1, 2018, most of those extensions have expired. Many states are already REAL ID-compliant, but if you live in the following states, you should probably have another form of ID ready to go just in case.
Idaho
Illinois
Louisiana
Massachusetts
Michigan
New Hampshire
New Jersey
New York
North Carolina
North Dakota
Rhode Island
Texas
Alaska
California
Oklahoma
Oregon
Virginia
If you live in any of these states, you should double check to make sure you have the correct ID. Sometimes you can use a military ID, passport, permanent resident card, or other form of ID in lieu of a driver’s license. In any case, it’s important to know before you board your flight.
There are several steps you can take to make sure you don’t miss your flight. If you are concerned that your state might be non-compliant, your first step should be to check the status of your state on the REAL ID Enforcement page. You can get to it by going to the Homeland Security website, or you can follow this link.
If your state isn’t compliant with the law, you can still travel, you just have to have the right ID. The TSA’s website has a section called Transportation Security Information, which you can access here . You should be able to find a list of acceptable forms of ID there.
If you live in Minnesota and the state is still non-compliant when you check the REAL ID Enforcement page, you can still travel with your ID if you have an Enhanced Driver’s License.
If you used to live in a state that’s non-compliant but you now live in a compliant state, it’s important to get a new driver’s license as soon as possible. Even if you live in a compliant state, if the license you’re using is from a non-compliant state you still won’t be able to board your flight unless you have another acceptable form of ID.
If you were ticketed or charged with a traffic-related crime and your driver’s license has a flag on it, you may also have trouble traveling. It’s important to consult with an experienced traffic attorney in your area to make sure you have the best shot at clearing your license so you can avoid potential restrictions.
